Intellectual property and image rights of Salvador Dalí and his worksSalvador Dalí died on 23 January 1989, having appointed the Spanish State as universal inheritor of all his goods, rights and artistic creations.By Royal Decree 799/1995 of 19 May, the Ministry of Culture was entrusted with administration and operation of the State-held intellectual property rights deriving from the artistic work of Salvador Dalí, and was authorised to grant the Gala-Salvador Dalí Foundation exercise of the powers to administer and operate those rights. That exercise was granted by the Ministry of Culture in its Order of 25 July 1995, and the Ministry and the Foundation signed an agreement in which it is specified that the powers are assigned on an exclusive basis, cover all types of operation and extend to all countries. The agreement empowers the Foundation to grant exclusive authorisations to third parties in order to make any form of operation possible, and in order to exercise the rights and measures that correspond to it, particularly those relating to breaches affecting its rights as assignee. On 9 October 1997 the Gala-Salvador Dalí Foundation and the Spanish artist's rights society Visual Entidad de Gestión de Artistas Plásticos (VEGAP) signed an agreement by which that company is to channel and process all applications and authorisations to reproduce works by Salvador Dalí, with the other artists' copyright management bodies from all over the world that form part of the International Council of Graphic and Plastic Arts (CIAGP) and the International Confederation of Societies of Authors and Composers (CISAC), which means that the work of Salvador Dalí is protected and defended worldwide. In any application to reproduce one or more works by Salvador Dalí on any medium it is essential to contact the artists' association or copyright agency of your country, or contact VEGAP directly in order to obtain the pertinent authorisation or licence. The Gala-Salvador Dalí Foundation has also been granted powers to manage and operate the rights to the image, industrial property, trade marks, patents and other intangible rights deriving from the artistic oeuvre of Salvador Dalí. The Ministerial Order, which was signed by the Minister of Education, Culture and Sport, Pilar del Castillo, on 8 January 2001, ordains that this cession is exclusive in nature, relates to all types of management and operation and covers all countries. The objectives of this management and operation of the rights to image, industrial property, trade marks, patents and other intangible rights deriving from the artistic oeuvre of Salvador Dalí will be the promotion, development, dissemination, protection and defence of the artist's image and artistic, cultural, intellectual and industrial work.
